ROOMMATE AGREEMENT

This Roommate Agreement (“Agreement”) is made on July 28, 2026 by the roommates listed below (“Roommates”), who share or will share the residence at [Property address] (“Residence”).

2. Term

This Agreement begins on [start date] and continues month-to-month until a Roommate moves out under Section 9 or all Roommates agree in writing to end it.

3. Rent

Total monthly rent for the Residence is [total monthly rent], due on the 1st day of each month. Each Roommate will pay the monthly share listed in the table below on or before the due date. A Roommate whose late payment causes a late fee under the lease is responsible for that fee.

4. Security deposit

The total security deposit is [total security deposit], contributed as listed above. When the landlord returns the deposit, each Roommate receives their contribution back, less deductions. Deductions caused by an identifiable Roommate (damage, cleaning, or unpaid amounts attributable to that Roommate) are borne by that Roommate; other deductions are shared in proportion to contributions.

5. Utilities and household bills

All shared utilities and recurring household bills (electricity, gas, water, internet, and similar) will be split equally among the Roommates and paid by the due date on each bill.

6. Cleaning and chores

Common areas (kitchen, bathrooms, living room) are cleaned weekly on a rotating schedule. Trash and recycling go out on collection day, rotating weekly. Each Roommate washes their own dishes within 24 hours and keeps shared surfaces clear.

7. Quiet hours

Quiet hours are 10:00 PM – 7:00 AM Sunday through Thursday; 12:00 AM – 9:00 AM Friday and Saturday. During quiet hours, Roommates will keep noise to a level that cannot be heard from another Roommate’s bedroom.

8. Guests and overnight stays

Short visits are welcome. An overnight guest may stay up to 3 consecutive nights. Longer or recurring stays require advance agreement from all Roommates, and a guest never becomes an occupant or tenant under this Agreement.

9. Early move-out and replacement

A Roommate who wants to move out before the end of the term will give the other Roommates at least 30 days’ written notice. The departing Roommate remains responsible for their rent and bill shares until a replacement acceptable to the remaining Roommates — and approved by the landlord, if the lease requires it — takes over those shares, or the term ends, whichever comes first. The departing Roommate’s deposit share is settled between the Roommates or with the replacement, since landlords typically return the deposit only when the whole tenancy ends.

10. The lease controls

This Agreement is a private contract between the Roommates. It does not modify the lease, does not bind the landlord, and does not change any Roommate’s obligations to the landlord — under most leases, each cotenant remains jointly and severally liable for the full rent. If this Agreement conflicts with the lease, the lease controls.

What to put in a roommate agreement

Money first: each person’s rent share with a due date, deposit contributions, and how utilities are divided. Courts generally enforce these financial promises between roommates — and because most leases make every cotenant liable for the full rent, the written split is what lets you recover from a roommate who stops paying.

Then the house rules — chores, quiet hours, overnight guests. A judge won’t order anyone to do the dishes, but agreeing on the rules in writing up front is what keeps you out of court in the first place.

When someone does leave: if a roommate moves mid-month, settle the partial month with the prorated rent calculator, and if the whole household is moving out, send the landlord a proper letter from the notice to vacate generator — it knows every state’s notice minimum.

Is a roommate agreement legally binding?

The financial terms generally are. Courts routinely enforce a signed roommate agreement’s money promises — rent shares, utility splits, deposit contributions — between roommates, often in small claims court. House-rules clauses like chores or quiet hours are rarely enforced by a judge, but writing them down still prevents most arguments. This tool provides general information, not legal advice.

Is a roommate agreement the same as a lease?

No. The lease is between the tenants and the landlord; the roommate agreement is a private contract between roommates only. It does not modify the lease and does not bind the landlord — if the two conflict, the lease controls. That is why the generated document says so explicitly.

What does “jointly and severally liable” mean for roommates?

Most multi-tenant leases let the landlord collect the full rent from any one cotenant — the landlord does not care about your private split. If a roommate skips their share, you may have to cover it to avoid eviction, then recover it from them. A signed agreement documenting each share is your paper trail for doing exactly that.

What should a roommate agreement include?

Seven things cover most disputes: who lives there and for how long; each person’s rent share and the due date; security-deposit contributions; how utilities and household bills are divided; cleaning and chores; quiet hours and overnight-guest limits; and what happens when someone moves out early. What happens if a roommate moves out early?

Under the agreement this tool generates, the departing roommate gives written notice (30, 45, or 60 days — you choose) and stays responsible for their rent share until an acceptable replacement takes over or the term ends. Remember the lease may also require the landlord to approve any replacement, and leaving the unit entirely usually means sending the landlord a separate notice-to-vacate letter.

Does a roommate agreement need a notary or a lawyer?

Generally no. A simple contract is valid once every roommate signs and dates it — print one copy per person and keep them. Notarizing is optional extra proof of who signed. For unusual situations (an owner-occupant renting rooms, subleases, or big money at stake), a local attorney review is worth it.
