Terms of Service

1. Acceptance of Terms

Brixaz ("Brixaz," "we," "us," or "our") operates the website brixaz.com (the "Service"). By accessing or using the Service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. These terms form a legally binding agreement between you and Brixaz and apply to all users and visitors.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. By using Brixaz, you represent and warrant that you meet these requirements, that you have the legal capacity to enter into this agreement, and that you will comply with all applicable federal, state, and local laws. The Service is intended for users within the United States and its 50 states.

3. The Service

Brixaz is a free classifieds listing platform that connects people for local gigs, services, jobs, housing, and for-sale items across the United States. Brixaz provides a venue for users to post and discover listings.

• Brixaz is NOT a party to any transaction, agreement, or communication between users.
• Brixaz does not verify the identity of users or the accuracy, legality, quality, or safety of any listing, item, service, or job posted.
• Posting and browsing listings is free. Brixaz does not charge fees or commissions on transactions.
• We do not endorse or recommend any user, listing, or content, and we do not control the conduct of users.

4. User Accounts

To post listings or use certain features, you may need an account. You are responsible for:

• Maintaining the confidentiality of access to your account
• All activity that occurs under your account
• Providing accurate and current information
• Notifying us immediately if you suspect unauthorized access

5. User Responsibilities & Prohibited Content

You are solely responsible for your listings, messages, photos, and other content, and for your interactions with other users. You will not post or do anything that:

• Is illegal, fraudulent, deceptive, or false
• Infringes a third party's intellectual property, privacy, or other rights
• Harasses, threatens, defames, or discriminates against others (including on bases prohibited by fair housing or employment laws)
• Offers illegal, dangerous, or restricted items, services, or jobs (e.g., firearms, drugs, recalled goods, or discriminatory job or housing ads)
• Is spam, duplicated, or miscategorized
• Contains malware or attempts to gain unauthorized access to the platform or other accounts
• Uses bots, scrapers, or automated tools without our written permission
• Impersonates another person or business

We may remove content and suspend or terminate accounts that, in our sole discretion, violate these terms, with or without prior notice.

6. Transactions Between Users

Brixaz only provides a venue to connect people; we do not participate in the actual transactions between buyers, sellers, employers, workers, landlords, or tenants. We do not vet users or listings. You are solely responsible for evaluating and investigating any person or business you deal with and for the safety of any meeting or exchange. Meet in public places, use caution, and exercise your own judgment. Brixaz is not responsible for any dispute, payment, delivery, injury, loss, or damage relating to transactions or interactions between users.

7. Intellectual Property

The name "Brixaz," the logo, the design, site text, code, and all other elements of the platform are owned by Brixaz and protected by United States intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of the content you post. By posting content on Brixaz, you grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content for the purpose of operating and promoting the Service. You represent that you have the right to grant this license.

8. No Warranties ("As Is")

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any listing, user, or content is accurate, legal, or reliable. You use the Service at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIXAZ AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR ANY TRANSACTION OR INTERACTION WITH ANOTHER USER. Because the Service is free, to the extent any liability is found, Brixaz's total cumulative liability to you will not exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Brixaz and its officers, employees, and agents from and against any claims, demands, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your content, your use of the Service, your interaction with other users, or your violation of these terms or any law.

11. Account Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account or access, and remove your content, at any time and for any reason, including violation of these terms, with or without prior notice. Provisions that by their nature should survive termination (including intellectual property, warranty disclaimers, limitation of liability, indemnification, and governing law) will survive.

12. Governing Law

These terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to its conflict-of-laws provisions. You agree that any dispute arising out of or relating to the Service will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these terms from time to time. The "Last updated" date above indicates when they were last modified. For significant changes, we will make reasonable efforts to notify you through a notice on the platform or by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated terms.
